If the driver does not have these documents together, the traffic police can not deduct the Challan immediately, If the driver claims to show the relevant documents within 15 days, then traffic police or RTO officials will not charge under Indian traffic rules and fines. If the driver does not have the said documents while driving, the driver must show these documents to the traffic police or officer within 15 days.
Meanwhile, under section 158 of the New Indian Motor Vehicle Act 2019, seven days have been given to show these documents in the event of an accident or special case. According to the new act, the absence of a driving license, Vehicle Registration Certificate (RC), Third Party Insurance Documents, Pollution and Control Certificate and License, if Traffic Police issued the challan and do not provide 15 days time, the driver has the option to present that document and the driver has the option to clear this challan in court.
According to the new traffic law, if the traffic police illegally issue a challan, it does not mean that the driver has to pay the invoice. For the information, the challan issued by the traffic police is not a court order. The driver can challenge the police-issued challan in court. Ongoing to court, the court may waive the fine if the court finds that the driver has all of the required documents, but has not been given 15 days to produce the documents.
At the same time, for your information, that a witness's signature is required when issuing a Challan by the traffic police according to the new traffic rules in India. When the challan is presented in court, the traffic police have to present the relevant witness to the court. If the traffic police are unable to bring a witness to court, the court may waive the driver's Challan. It has been observed that in most cases, the traffic police are unable to produce witnesses, which often benefits the driver.
